2021/22 MATCH TICKET TERMS & CONDITIONS

 

Definitions

 

In these Terms and Conditions, some words are capitalised meaning that they are defined further below:

 

Adult: means anyone aged 26 and over on the date the ticket is purchased

Club: means Wasps Holdings Limited incorporated and registered in England and Wales under Company Number 04187289 and whose registered office is at Coventry Building Society Arena, Judds Lane, Longford, Coventry, CV6 6AQ

Concession: means anyone aged 65 and over (Senior), 18-25 (Young Adult), 17 & under, 11 & under, anyone serving in the armed forces and those working for the blue light services

 

COVID-19: means the coronavirus disease caused by the severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), known as ‘COVID-19’, and/or any variations or mutations thereof

 

COVID-19 Event: means COVID-19 and/or any other epidemic(s) or pandemic(s)

 

Ground Regulations: means regulations governing access to and the proper conduct of persons in attendance at the Stadium

 

Guest: means a person attending a Match as a friend, relative or guest of a Ticket Holder

 

Match(es): means any association rugby match taking place at the Stadium

Match Ticket: means a ticket issued by or authorised for sale by the Club entitling the Ticket Holder to access the Stadium and attend a particular Match only and subject to the terms and conditions set out in clause 1

Regulations: means any statute, statutory instrument or other regulations of binding effect from time to time in force in England and including rules and regulations of the Rugby Authorities 

Rugby Authorities: rules, regulations and byelaws of the Rugby Football Union, Premiership Rugby Limited, European Professional Club Rugby and Wasps Holdings Limited (the Club) and any other Rules, Regulations and/or Bye-Laws applicable to the Club and/or any matches

 

Season: means the 2021/22 season as determined by the Rugby Authorities, usually from September to the end of May

Stadium: means Coventry Building Society Arena, Judds Lane, Longford, Coventry, CV6 6AQ

Ticket Holder: means a purchaser of a Match Ticket or for whom and in whose name a Match Ticket has been bought entitling them to access the Stadium

 

 

 

1 Your Contract with the Club

  • By the purchase of a Match Ticket and by access to the Stadium, a Ticket Holder shall be deemed to have agreed to be bound by the following: 
  • these Match Ticket Terms and Conditions
  • the Ground Regulations and any other applicable Regulations
  • any applicable COVID-19 Terms and Conditions and Regulations
  • any applicable COVID-19 Supporter Code of Conduct

 

which together will constitute the entire agreement between the Ticket Holder and the Club to the exclusion of any non-fraudulent representation or marketing materials.

 

1.2 The Club reserves the right to change these Match Ticket Terms and Conditions from time to time and shall notify you of such changes if they materially affect your rights as a consumer.

1.3 You acknowledge that the Club will hold and process data relating to you, which may include personal data, for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's then current privacy policy available from www.wasps.co.uk

1.4 If these Match Ticket Terms and Conditions are not accepted a Match Ticket should not be purchased.

  1. Access Conditions

2.1 Ticket Holders will be responsible for compliance and observance with these Terms and Conditions and with the Ground Regulations. Misconduct of the Ticket Holder or Guests, failing to adhere to these Terms and Conditions or acting in a manner which the Club reasonably considers is detrimental to its interests or is likely in the reasonable opinion of the Club to bring rugby or the Club into disrepute shall permit the Club to confiscate or forfeit (in each case without compensation) the Ticket, to prevent access to the Stadium for the Match in question and/or to ban the Ticket Holder from attending future Matches or other events at the Stadium or at away games at other venues for such time as the Club deems appropriate. The Club will seek where relevant to prosecute to the full extent of the law where applicable as well as informing the Rugby Authorities or law enforcement agencies of any breaches of this nature.

2.2 Entrance to the Stadium is only permitted upon presentation of a valid Match Ticket, which should be retained until the Match in question has been played to a conclusion. In addition, upon request, proof of identity may be required.

2.3 The Match Ticket gives access only to the stand, block, row and/or seat indicated and not to any other stand, block, row and/or seat within the Stadium. However, the Club reserves the right to re-allocate the Ticket Holder to any other seats or areas in the Stadium at any time, save as otherwise provided in these Terms and Conditions.

2.4 No person (other than the holder of a valid licence granted by the Club's consent) may bring into, or use within, the Stadium any equipment which is capable of recording or transmitting any audio, visual or audio-visual material or any information or data in relation to a Match or any aspect of it or the Stadium, other than mobile phones or like devices for personal non-commercial use.

2.5 Save for official Club merchandise and/or other rugby related clothing worn in good faith, you shall not bring into, use or display within the Stadium any sponsorship, promotional or marketing materials.

2.6 You shall not offer or distribute (either free or for sale by any person) within the Stadium any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe this clause 2.6 where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order and which have been agreed in writing in advance by the Club.

2.7 The Match Ticket remains the property of the Club at all times.

  1. Concessions

3.1 When a Concession Match Ticket is purchased, proof of identity and concession entitlement may be required at the point of ticket collection and/or entry to the ground.

3.2 Anyone found trying to collect a Match Ticket and/or gain entry with the intention of using a Match Ticket within an incorrect price band will be required to purchase another Match Ticket at full match day adult rate without the right for a refund on the original concession ticket.

3.3 Concession prices may be offered for those aged 65 and over (Senior), 18-25 (Young Adult), 17 & under, 11 & under, anyone serving in the armed forces, those working for the blue light services and disabled supporters. At the Club’s discretion you may be asked to provide proof of your concessionary status. Concession price criteria are applicable as at the date the ticket is purchased. 

3.4 Children aged under 13 may not enter the Ground unless accompanied by an adult aged 18 or over. The Club are also unable to speak to any child under the age of 13 without the permission of their parent/guardian.

3.5 Children aged 3 and over must be in possession of a valid Match Ticket for the Match they are attending. A child aged 2 and under may enter the Ground for free without a Match Ticket if accompanied by an adult aged 18 or over, but in such an event, no seat shall be provided for that child and such admission is subject to availability. His/her parent(s) and/or legal guardian(s) shall, in addition to the Ticket Holder, be responsible for the child’s actions, conduct and compliance with the Terms and Conditions and Ground Regulations.

3.6 For disabled supporters, the Club shall provide, in its sole discretion, assistance by way of a complimentary personal assistant Match Ticket where it is deemed necessary (subject to availability and supporting evidence upon request).

3.6 Disabled supporters are defined within the Club’s Disabled Ticketing Policy or via the Customer Service Department at the Stadium.

3.7 The Club reserves the right to alter these price age bands and will use reasonable endeavours to provide notice to Ticket Holders via www.wasps.co.uk or by email relating the changes to the system by which Match Tickets are sold. Anybody found to be using a concession ticket unjustly to gain entry to the Stadium will be liable to denied entry or ejection & suspended from future matches. No refund will be given.

  1. Changes to Dates, Refunds & Exchanges

4.1 No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever. Your Match Ticket will enable you to attend the re-arranged Match.

4.2 Subject to Clause 8 (COVID-19), where a Match is abandoned, postponed or cancelled for any reason the Club shall have no liability to a Ticket Holder and, in such an event, Ticket Holders shall be entitled to attend any corresponding re-arranged match. The Club will have no further liability whatsoever, including (but not limited to) any direct or consequential loss or damage, loss of enjoyment or travel costs.

4.4 All Match Ticket sales are strictly non-refundable.

4.5 If for any reason the date and/or time of a Match is altered after a Match Ticket has been purchased it is the responsibility of the Ticket Holder to ascertain the correct date and time of the fixture. The Club will use all reasonable endeavours to make this information publicly available as soon as any changes have been made. The Club is under no obligation to give any form of recompense to anybody who misses a Match due to a date and/or time change duly notified by the Club.

4.6 In the event of a Match Ticket being lost, damaged or misplaced the Club is under no obligation to provide a duplicate Match Ticket.

  1. Ticket Resale

5.1 The resale of any Match Ticket is strictly prohibited. A Match Ticket shall become void and will not allow entry to the Stadium or have any right to a refund where the Club believes it has been sold to another person, sold on the internet (through unauthorised ticket brokers, auction sites or otherwise) or any other medium whether now or hereafter developed or it has been used as a prize in a lottery, competition or for any other promotional or advertising purpose unless expressly authorised by the Club in writing.

5.2 The Club will seek where relevant to prosecute to the full extent of the law where applicable as well as informing other bodies either Rugby Authorities, or other law enforcement agencies of any breaches of this section.

  1. Match Ticket Bundles

6.1 Match Ticket bundles will need to be used within a single season and cannot be transferred over to a new season.

6.2 There will be no refunds payable in respect of any Match Ticket bundle. However, in the event of a postponement, the Match Ticket for the chosen Match can be transferred to a different Match, subject to availability.

6.3 Season Memberships are not defined as Match Ticket bundles. Season Members should refer to the relevant Season Membership Terms & Conditions.

  1. Liability of the Club

7.1 Nothing in these Terms and Conditions shall operate to exclude or limit the Club's liability for death or personal injury caused by the negligence of the Club, its servants, agents, employees or sub-contractors or for fraudulent misrepresentation.

7.2 Subject to 7.1, the Club's total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the sale of any Match Ticket shall be limited to the face value of the Match Ticket for the Match in respect of which the liability arose.

7.3 Subject to 7.1, the Club shall not be liable for any special, indirect or consequential loss or damage or for loss of profit, loss of business, loss of enjoyment, loss of anticipated savings or depletion of goodwill which arise out of or in connection with the sale of the Match Ticket.

7.4 The Ticket Holder shall indemnify the Club in respect of any claims, liabilities, damages, costs, expenses or losses incurred by the Club arising from or in connection with any breach of these Terms and Conditions, the Ground Regulations and applicable Regulations by the Ticket Holder or any Guest for whom the Ticket Holder may be responsible.

  1. COVID-19

8.1 As a result of the COVID-19 pandemic, these Terms and Conditions, including all rights granted and the obligations of the Club hereunder, are subject to any restrictions or requirements from time to time imposed by Applicable Law or the Regulations in relation to a COVID-19 Event. In the event of any conflict or inconsistency between the provisions of these Terms and Conditions and any such Applicable Law or Regulation, the relevant Applicable Law or Regulation shall prevail.

8.2 All Ticket Holders are required in connection with their attendance at the Stadium to comply with all applicable laws/regulations, Government guidance and the Club’s directions (including any applicable COVID-19 Supporter Code of Conduct from time to time). This includes the strict requirement that Ticket Holders must not attend the Stadium if they are restricted from doing so as a result of any COVID-19 related laws and/or regulations from time to time, whether due to self-isolation requirements, local travel restrictions, or otherwise. No refunds shall be due in such circumstances unless the Club determines otherwise in its absolute discretion.

  1. Publicity

The Club may from time to time create images and/or audio-visual video footage of Clients attending the Stadium. The Club owns all rights in such images and footage and shall be entitled to use the same for the purpose of: (i) promoting the Club and its commercial partners; and (ii) any other commercial activity provided in each case that such use does not harm the reputation of the relevant individual whose image is used.

  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.
